Terms of Service

These Terms govern your use of Lucenta and the website at lucenta.ai (the "Service"), operated by MCPLD LLC, a New Mexico limited liability company ("Lucenta", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Lucenta analyses how AI assistants (such as ChatGPT, Claude, Gemini, and Perplexity) and AI search features describe and recommend brands, and provides reports, scores, and recommendations. Reports are informational and reflect a point-in-time snapshot of third-party systems we do not control.
2. Accounts
We use passwordless "magic link" sign-in. You are responsible for keeping access to your email secure and for activity under your account. You must provide accurate information.
3. Acceptable use
You agree not to: use the Service to audit domains or brands in a way that harasses or harms others; abuse, overload, scrape, or attempt to disrupt the Service; reverse engineer or copy the Service; resell or redistribute the Service or its reports without our permission; or exceed or circumvent rate limits and usage controls.
4. Subscriptions and billing
Paid plans (such as Starter, Pro, and Agency) are billed in US dollars through Stripe on a monthly or annual basis, as selected at checkout. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then. Prices and plan features may change, with notice for active subscriptions. You are responsible for any applicable taxes.
5. Refunds
Except where required by law, payments are non-refundable, including for partial billing periods. If you believe you were charged in error, contact us through our form at lucenta.ai/contact.
6. Free audits
Free audits are provided "as is", may be subject to usage limits, and may change or be discontinued at any time.
7. No guarantee of results
We do not guarantee any particular outcome. The Service does not guarantee that AI assistants will mention or recommend you, that your visibility will improve, or that any recommendation will produce a specific result. AI systems are operated by third parties, change frequently, and produce variable output.
8. Intellectual property
We own the Service and all related software, content, and trademarks. You retain ownership of the data you submit. We grant you a limited, non-exclusive licence to use the reports we generate for your own business purposes.
9. Third-party services
The Service relies on third-party AI and data providers. We are not responsible for their availability, accuracy, outputs, or changes.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Lucenta and MCPLD LLC will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
12. Indemnification
You agree to indemnify and hold harmless MCPLD LLC from claims arising out of your use of the Service or your breach of these Terms.
13. Termination
We may suspend or terminate your access if you breach these Terms or misuse the Service. You may stop using the Service at any time.
14. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. The courts located in New Mexico will have jurisdiction, subject to any mandatory consumer protections of your country of residence.
15. Changes to these Terms
We may update these Terms. We will revise the "Last updated" date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.
